MANDATE

The department of Civil Litigation and International Law is mandated to provide legal services to Government in all areas of public and private law, administrative law, constitutional law, public international law and private international law.

MISSION

To provide legal services to Government Ministries, Departments, Agencies and The Gambia's overseas mission with an emphasis on the adherence to Rule of Law, Good Governance and Justice for all.

VISION

The department of civil litigation and international is headed by the Director of Civil Litigation who is deputized by the Deputy Director of Civil Litigation.The Department further consists of Principal State Counsels, Senior State Counsels and State counsels, in this order.

GENERAL FUNCTIONS

Representing Government in all civil matters at the Magistrates Courts, High Courts, Court of Appeal and Supreme Court
  • Defending Government
  • Suing on behalf of Government
  • Recovery of debts owned to Government
  • Negotiating out of courts settlements on behalf of Government

Negotiation and Mediation on behalf of Government Ministries, Departments and Agencies

Drafting and vetting of contracts and Memorandum of understanding for Governments Ministries, Departments and Agencies

Proffering legal advice to Government Ministries, Departments and Agencies

INTERNATIONAL LAW FUNCTIONS

  1. Vetting of International agreements between The Gambia and other Nations
  2. Proffering advice to Government Ministries, Departments, Agencies and the Gambia's Oversees Missions on matters relating to international law
  3. Ratification of International Agreements
  4. Ensuring that all Treaties entered into by The Gambia are deposited and Registered in the Ministry accordance with the Constitution of The Gambia
  5. Ensuring observance of The Gambia's treaty obligations.
  6. Responding to communications from the United Nations Human Rights Commission (UNHCR) and the African Commission on Human and People's Right (ACHPR) on allegations of violations of humans rights, and other International Organization in general.
  7. Coordinating The Gambia's defense internationally in arbitation cases before Arbitral Tribunals as well as representing The Gambia at ECOWAS Community Court.

State's implementation of the International Covenant on Civil and Political Rights (ICCPR)

Following a 33 year delay, the Solicitor General and Legal Secretary from 5th to 6th July 2018 led a high level delegation comprised of officials from the Office of the President, Ministry of Justice, Ministry of Interior, Ministry of Basic and Secondary Education, Ministry of Health and Social Welfare and Women's Bureau to engage in dialogue with the Human Rights Committee on the recently submitted response to the List of Issues posed by the Committee on the State's implementation of the International Covenant on Civil and Political Rights (ICCPR).

Turkish Embassy Donates state of the art Computers and IT equipment to aid in the work of the Ministry of Justice.Turkish Ambassador announces further cooperation training exchanges between Attorney General's Chamber & Ministry of Justice and Turkish Justice Academy.The official handing over of the I.T equipments(Computers,Printers and UPS(Power Supply Connectors)) occured at the Ministry of Justice conference room where the materials where handed over by the Turkish Ambassador to the Attorney General and Minister of Justice(Hon. Abubacarr Tambadou),Tuesday,3rd October,2017.
