The Criminal Division of the Attorney General's Chambers and Ministry of Justice of the Republic of The Gambia is a public office created under section 84 (1) of the 1997 Constitution of the republic of The Gambia.
The Criminal Division has a strong and formidable team of lawyers comprising of the :
- Director of prosecutions
- Deputy Director of Public Prosecutions
- Principal State Counsel
- Senior State ounsel
- State Counsel
- Public Prosecutors and
- Legal Clerks
The Office ofthe Director of Public Prosecutions is under the Criminal Diviion and it is inter alia, saddled with two main responsibilities. Firstly,the responsibility of commencing and undertaking, taking over and countinuing or discountinuing criminal proceedings against or in respect of any offender in The Gambia subject to the direction and control of the Attorney General as per section 85 (4) of the aforesaid Constitution.
The Office of the Director of Public Prosecutions prosecutes accused persons for acts or omissions, which the law of the country forbid and prescribes sanction or punishment. Secondly, the Criminal Division, advices Government Ministries, Parastatals and security agencies including, but not limited to The Gambia Police Force. National Intelligence Agency and th National Drugs Law Enforcement Agency on criminal matters afecting individuals, corporations and the State.
The Criminal Division is ably headed by the Director of Public Prosecutions who works together in harmony with his team of lawyers to achieve its desired Constitutional objectives.
The Director of Public Prosecutions, as well as all the State Counsel under him have right of audience before all the courts in The Gambia to prosecute and defend appeals lodged against the State. The Public Prosecutiors on the other hand, also work directly under the supervision of the Director of Public Prosecutions. They draft legal opinions, charges and prosecute accused persons only before the Magistrates' Court.
As a public office, the Criminal Division of the Attorney General's Chambers and Ministry of Justice is committed to providing sound and tenable legal advice to Government and the Gambian Public in all criminal matters and in accordance with the Laws of The Gambia
